亚马逊外观专利侵权模版分享（附超详细侵权信写作思路！）

亚马逊一直以来在品牌保护方面都做得比较到位，对侵权行为的打击一直都是很严格，许多卖家在日常运营中稍微不注意就有可能还会被侵权举报，被举报就会被产品下架，严重的话还可能封店处理。所以了解亚马逊平台的规则是很有必要的，这样可以避免侵权。如果我们被举报侵权了，应该如何申诉回来呢?下面我就把方法教给大家。

一、哪些行为可能会侵权

1. 版权：侵犯版权，通常指侵犯作者的著作权。这类侵权，中国卖家还是比较少碰到。

2. 商标权：未得到产品品牌官方的正规授权，擅自使用对方的商标或LOGO。

3. 发明专利权：如果出售的产品是别人发明的，而且别人申请了专利保护，卖家未经允许擅自生产销售，也就是指销售仿品。

4. 外观设计专利权：是指对产品的形状、图案、色彩或者其结合所做出的富有美感并适于工业上应用的新设计。外观设计是指工业品的外观设计，也就是工业品的式样。外观专利有60%以上相似就视为侵权假货

二、卖家收到侵权以后应该怎么成功申诉?

1、首先审视自己是否侵权，如果确实没有侵权，或者有授权书，可以直接与亚马逊官方沟通，提供相关证据，证明自己。

2、查清楚对方的商标专利申请情况，如果对方提供了专利详情，确认产品侵权，这种情况的话直接下架listing， 并且积极和投诉方沟通，看是否可以通过签订保证书或者给一些赔偿金，让其撤诉。如果对方要求的赔偿金较多，卖家可以去审视一下自己的账号是否值得挽救回来，或者也可以请知识产权律师代为沟通。

3、如果平台直接下架了listing，联系对方拒绝提供专利详情，这种情况可以联系平台告知说对方可能是恶意骚扰，拒绝提供任何的侵权证明，要求平台恢复销售权限。

申诉要点：

1.第一时间下架侵权产品不要抱有侥幸心理，并检测整个店铺是否有类似产品全部下架。

2.联系邮件中给出的投诉者，承认错误无心之失，言辞恳求，告知已经下架产品承诺不再销售他们品牌的产品并抄送给亚马逊notice邮箱。

3.申诉信:

-资料上有进货发票和其他有效证明可以提交作为辅助

-说明已经在第一时间删除产品并保证不再销售

-加大产品品牌/专利/真伪方面的检测 100%确定没有问题才会上架
